Objects and Reasons

The object and reasons of this Bill are to amend the Development Planning Act (Cap. 552) with the aim of strengthening the legislative framework governing land use and development control in Malta. The Bill introduces clarifications to key definitions, updates institutional references, and enhances procedural fairness, transparency, and consistency in planning decisions. It empowers the Planning Authority to issue guidance circulars, improves the regulation of ownership and consent in development applications, and consolidates rules on vested rights, renewal of permits, and public participation. The proposed amendments also refine enforcement mechanisms and compensation rules, clarify the revocation and modification of permits in cases of fraud or material error, and allow for policy application based on site-specific considerations. These reforms seek to improve legal certainty, and ensure more coherent and efficient planning processes.
