Objects and Reasons

The objects and reasons of this Bill are to amend the definition of Schengen Information System in the Criminal Code which referred to a now repealed Council Decision, to provide for new categories of Schengen Information System alerts and checks pursuant to Regulation (EU) 2018/1862 of the European Parliament and of the Council of 28 November 2018 on the establishment, operation and use of the Schengen Information System (SIS) in the field of police cooperation and judicial cooperation in criminal matters, amending and repealing Council Decision 2007/533/JHA, and repealing Regulation (EC) No 1986/2006 of the European Parliament and of the Council and Commission Decision 2010/261/EU, as well as to amend various articles of the Criminal Code with a view of imposing criminal liability for the misuse of electronic communication, to revise the provisions regulating the procès-verbal, the substitution of the concept of traffic in persons with that of smuggling of persons as well as to review the penalties imposed for offences relating to smuggling of persons.
